These Terms of Service ("Terms") govern your access to and use of MusoCover, an AI album cover generator operated by Dawid van den Berg, trading as Akreative ("MusoCover," "we," "us," or "our"), a sole proprietor based in South Africa. By creating an account, purchasing credits, or otherwise using MusoCover at musocover.com or app.musocover.com (the "Service"), you agree to these Terms. If you do not agree, please do not use the Service.
You must be at least 16 years old to create an account. If you are under 18, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Provide accurate information when signing up, and let us know at support@musocover.com if you believe your account has been compromised.
MusoCover lets you generate AI album cover artwork by selecting genre, mood, and style options, then customize the result with your own logo, artist name, and track title. The Service is provided on a credit basis — each generation consumes credits from your account balance.
We may add, change, or remove features, and may modify credit costs for new generations going forward. We'll make reasonable efforts to communicate material changes to active users in advance.
Credits are purchased in packs and do not expire once granted to your account. Credits have no cash value, are non-transferable between accounts, and are not redeemable for cash except where required by law.
Payments are processed by Paddle.com Market Limited, who acts as the Merchant of Record for all purchases. This means your transaction is with Paddle, not directly with us — Paddle handles billing, applicable sales tax/VAT, payment card processing, and buyer-facing receipts. Refund requests are handled under Paddle's Buyer Terms, and you can also reach us directly at support@musocover.com if a purchase didn't work as expected — we'll do what's reasonable to make it right.
We reserve the right to revoke credits obtained through fraud, chargebacks, or abuse of free-credit or promotional mechanisms (including but not limited to creating multiple accounts to bypass free-generation limits).

Your inputs: Any logo, image, artist name, or text you upload or enter remains yours. You grant us a limited license to process that input solely to generate your requested cover art.
Generated output: Subject to your compliance with these Terms and full payment of any credits used, you own the album cover artwork generated for you and may use it commercially (e.g. as artwork for release on streaming platforms, merchandise, or promotional material).
Important limitation: Because generations are produced by an AI image model, we cannot guarantee that any given output is unique or free of unintentional similarity to existing copyrighted artwork, trademarks, or other AI-generated images produced for other users. We do not conduct copyright or trademark clearance on generated images. You are responsible for evaluating whether a given piece of output is suitable for your intended use, particularly for commercial release.
The Service itself — including the MusoCover name, logo, website, and underlying software — is owned by Dawid van den Berg (trading as Akreative) and may not be copied, reproduced, or used without permission.
Album cover images are generated using third-party AI image generation technology (see Section 7). AI generation is inherently variable — results may differ from what you expect, may occasionally contain visual artifacts or errors, and are provided "as is." We do not guarantee that any specific prompt, genre, or style selection will produce a particular result.
MusoCover relies on third-party providers to operate, including Pollinations AI (image generation), Paddle (payments), Supabase (accounts/authentication), Cloudflare (hosting, storage, and email routing), and Resend (transactional email). Full detail on what data flows to each provider is in our Privacy Policy. We aren't responsible for outages, errors, or changes in these providers' own services that affect MusoCover's availability.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that generated output will meet your requirements.
To the maximum extent permitted by law, Dawid van den Berg (trading as Akreative) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data, arising from your use of the Service. Our total liability for any claim arising from these Terms or the Service is limited to the amount you paid us in the 3 months preceding the claim.
Nothing in these Terms limits liability that cannot be excluded under South African law, including under the Consumer Protection Act, 68 of 2008, to the extent it applies to you.
You agree to indemnify and hold Dawid van den Berg (trading as Akreative) harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your misuse of the Service, your violation of these Terms, or your infringement of any third party's rights through content you upload or generate.
You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate your account for violation of these Terms, suspected fraud or abuse, or if required by law. Unused credits are non-refundable upon termination for cause, except where required by law.
We may update these Terms from time to time. If we make material changes, we'll notify active users by email or an in-app notice before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance.
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be subject to the non-exclusive jurisdiction of the South African courts, without prejudice to any statutory rights you may have as a consumer in your own country of residence.
